As a coach of the 2019\/20 Humboldt University Vis Moot team, I\u00a0<\/span>was<\/span>\u00a0confronted with\u00a0<\/span>many\u00a0<\/span>challenges<\/span>\u00a0that we all share during these times of crisis.\u00a0<\/span>How do we carry on business as usual? Can we carry on business as usual? How do we keep up our good spirits? Is it a feasible option to move dispute resolution online?\u00a0<\/span>I believe that this season\u2019s Vis experience serves as an example of how an organisation and a global community can react during these times, and what lessons can be learnt.<\/span>\u00a0<\/span><\/p>\n

<\/p>\n

What we usually expect<\/span>\u00a0<\/span><\/h3>\n

The Willem C. Vis International Commercial Arbitration Moot Court\u00a0<\/span>(<\/span>\u201cVis\u201d<\/span>\u00a0for short<\/span>)\u00a0<\/span>has\u00a0<\/span>previously\u00a0<\/span>been the\u00a0<\/span>subject<\/span>\u00a0of\u00a0<\/span>discussion<\/span>\u00a0in this Journal,\u00a0<\/span>notably in Tun de Jong\u2019s article<\/span>\u00a0<\/span>\u201cMoot Courts \u2013 The Art of Persuasion\u201d<\/span><\/a>.\u00a0<\/span>\u00a0<\/span>The\u00a0<\/span>student competition is one the largest in the world, with over 300 universities sending a team\u00a0<\/span>which will spend half a year<\/span>\u00a0tackl<\/span>ing<\/span>\u00a0a case in international sales law and arbitration.\u00a0<\/span>\u00a0<\/span><\/p>\n

After<\/span>\u00a0prepar<\/span>ing<\/span>\u00a0<\/span>two<\/span>\u00a0<\/span>memoranda over the winter,<\/span>\u00a0<\/span>the teams travel to the\u00a0<\/span>oral hearings in Hong Kong<\/span>\u00a0and Vienna just before Easter. There, they take on the roles of party counsel<\/span>\u00a0<\/span>and compete against each other in a system akin to the football world cup, with general rounds followed by knock-out elimination rounds.\u00a0<\/span>Prizes are awarded for outstanding memoranda and individual speakers, as well for\u00a0<\/span>Academic Excellence and Party Condition<\/span>\u00a0(known as the Joseph Schwartz award)<\/span>.<\/span>\u00a0<\/span><\/p>\n

A year ago, when<\/span>\u00a0I started my\u00a0<\/span>coaching\u00a0<\/span>journey<\/span>,<\/span>\u00a0<\/span>we were in the<\/span>\u00a0team<\/span>\u00a0selection process. During the interviews, we told the candidates\u00a0<\/span>the story of what expected them: They<\/span>\u00a0would be getting themselves knee deep into two fields\u00a0<\/span>that are fascinating yet\u00a0<\/span>entirely irrelevant to the German State Exam curriculum: international commercial arbitration and\u00a0<\/span>t<\/span>he\u00a0<\/span>1980\u00a0<\/span>UN Convention on the International Sale of Goods<\/span>, aka\u00a0<\/span>CISG). After\u00a0<\/span>a<\/span>\u00a0rather arduous process of\u00a0<\/span>writing<\/span>\u00a0two memoranda<\/span>\u00a0over the winter<\/span>, the experience would\u00a0<\/span>then\u00a0<\/span>culminate in fantastic travels to the oral rounds in<\/span>\u00a0both<\/span>\u00a0Vienna<\/span>\u00a0(Vis) and Hong Kong (Vis East)<\/span>\u00a0just before Easter<\/span>\u00a02020<\/span>.\u00a0<\/span>\u00a0<\/span><\/p>\n

We treated this as a<\/span>\u00a0fact\u00a0<\/span>which<\/span>\u00a0we took<\/span>\u00a0<\/span>for granted<\/span>:\u00a0<\/span>o<\/span>f course we would be going to Hong Kong in Vienna<\/span>, as we had all these years before! It is the 27<\/span>th<\/span>\u00a0<\/span>anniversary<\/span>\u00a0of the Vis Moot<\/span>\u00a0and the 22<\/span>nd<\/span>\u00a0time\u00a0<\/span>that Humboldt<\/span>\u00a0<\/span>U<\/span>niversity is participating,<\/span>\u00a0and\u00a0<\/span>during all these years,<\/span>\u00a0<\/span>the\u00a0<\/span>event\u00a0<\/span>has seen<\/span>\u00a0a constant upward trajectory in terms of participating teams and arbitrators.\u00a0<\/span>Now<\/span>, we\u00a0<\/span>are<\/span>\u00a0suddenly confronted with\u00a0<\/span>whether\u00a0<\/span>this seemingly\u00a0<\/span>infinite<\/span>\u00a0growth<\/span>\u00a0is sustainable<\/span>.<\/span>\u00a0<\/span><\/p>\n

But this time, nothing was as expected<\/span>\u00a0<\/span><\/h3>\n

The political realities of the world caught up with us this year. Already in the summer, news of political unrest and protests\u00a0<\/span>reached<\/span>\u00a0us from Hong Kong. As a consequence, many teams decided\u00a0<\/span>to drop<\/span>\u00a0out of the Vis East\u00a0<\/span>then<\/span>.\u00a0<\/span>This even included the University of Amsterdam, who had won the competition the previous year.<\/span>\u00a0We decided to\u00a0<\/span>proceed<\/span>, submitting our Memorandum for Claimant in early December<\/span>, followed by<\/span>\u00a0the Memorandum for\u00a0<\/span>Respondent.\u00a0<\/span>One<\/span>\u00a0week before the submission deadline in January, the news reached us that the oral hearings\u00a0<\/span>in Hong Kong\u00a0<\/span>would not take place<\/span>\u00a0due to the spread of Covid-19<\/span>.\u00a0<\/span>\u00a0<\/span><\/p>\n

The\u00a0<\/span>team members<\/span>\u00a0of course mourned the loss of their much-anticipated springtime trip<\/span>\u00a0to<\/span>\u00a0Hong Kong<\/span>,<\/span>\u00a0but kept attending pre-moots in preparation for the competition in Vienna<\/span>\u00a0<\/span>that<\/span>\u00a0was still set to take place<\/span>. In early March, we\u00a0<\/span>even<\/span>\u00a0<\/span>invited<\/span>\u00a0<\/span>21 teams from 12 countries to\u00a0<\/span>our own Berlin Premoot. Halfway through the weekend, the news hit that the Vis in Vienna\u00a0<\/span>also had to be cancelled<\/span>.\u00a0<\/span>\u00a0<\/span><\/p>\n

Only a few days\u00a0<\/span>later<\/span>, Humboldt University was shut down entirely and social distancing measures implemented throughout\u00a0<\/span>Europe<\/span>.<\/span>\u00a0<\/span>In hindsight,\u00a0<\/span>I am<\/span>\u00a0a<\/span>ll the more\u00a0<\/span>glad<\/span>\u00a0that we were<\/span>\u00a0able to organise the Berlin Premoot, creating a space\u00a0<\/span>in which we could practice together and enjoy each other\u2019s company one last time<\/span>.<\/span>\u00a0<\/span>\u00a0<\/span><\/p>\n

\u201cImprovise, adapt, overcome\u201d<\/span>\u00a0<\/span><\/h3>\n

T<\/span>his was our new reality.\u00a0<\/span>All<\/span>\u00a0<\/span>pleading\u00a0<\/span>sessions\u00a0<\/span>would<\/span>\u00a0<\/span>be<\/span>\u00a0held online<\/span>\u00a0instead<\/span>. W<\/span>e<\/span>\u00a0felt we had little else left to do but to make the most of it. A\u00a0<\/span>US Marines motto<\/span>\u00a0came to mind<\/span>:\u00a0<\/span>improvise, adapt, overcome<\/span><\/i>!<\/span><\/i>\u00a0<\/span>This<\/span>\u00a0could be our chance to dip\u00a0<\/span>our<\/span>\u00a0toes in the waters of\u00a0<\/span>ODR, Online Dispute Resolution<\/span>.\u00a0<\/span>During this<\/span>\u00a0adventure, our observations\u00a0<\/span>were twofold:\u00a0<\/span>\u00a0<\/span><\/p>\n

First<\/span>ly<\/span>,\u00a0<\/span>as<\/span>\u00a0<\/span>always<\/span>\u00a0for the Vis<\/span>,<\/span>\u00a0practitioners from around the world<\/span>\u00a0sat as arbitrators<\/span>. From many of them we heard that this was their first online hearing and that they thoroughly enjoyed it.<\/span>\u00a0<\/span>And secondly, on our part, the team got to\u00a0<\/span>acquire<\/span>\u00a0an entirely new skillset. They liaised with teams around the world via various social media to make an online practice hearing schedule. They\u00a0<\/span>managed these<\/span>\u00a0via a handful of different online conferencing tools. They had to present in front of a camera instead of a real life tribunal. All these I am sure will be useful skills during their future careers.<\/span>\u00a0But, our brief encounter with ODR aside,\u00a0<\/span>is<\/span>\u00a0<\/span>how\u00a0<\/span>the pleadings<\/span>\u00a0are conducted<\/span>\u00a0really all that the Vis experience is about?<\/span>\u00a0<\/span><\/p>\n

What<\/span>\u00a0about t<\/span>he social element<\/span>?<\/span>\u00a0<\/span><\/h3>\n

I remember the Vis\u00a0<\/span>opening ceremony<\/span>\u00a0of when I was\u00a0<\/span>a participant myself<\/span>. There,<\/span>\u00a0the organisers\u00a0<\/span>aptly described the Vis as<\/span>\u00a0<\/span>being \u201c<\/span>not a competition with an educational element,\u00a0<\/span>but<\/span>\u00a0an educational event with a competitive element.\u201d\u00a0<\/span>This\u00a0<\/span>focus on an\u00a0<\/span>educational aspect includes also an\u00a0<\/span>important\u00a0<\/span>element of social networking with all the arbitration lawyers from around the world\u00a0<\/span>that\u00a0<\/span>gather in Vienna. It includes an element of humanness which largely gets lost in online pleadings.<\/span>\u00a0<\/span>\u00a0<\/span><\/p>\n

While<\/span>\u00a0of course\u00a0<\/span>a main<\/span>\u00a0takeaway for the\u00a0<\/span>teams<\/span>\u00a0each year lies in the skills they gain in memorand<\/span>a<\/span>\u00a0writing and oral advocacy,\u00a0<\/span>the experience<\/span>\u00a0<\/span>is also<\/span>\u00a0measured by the\u00a0<\/span>number of\u00a0<\/span>business cards\u00a0<\/span>exchanged<\/span>\u00a0in the moot bars in HK and Vienna<\/span>\u00a0over glasses of wine<\/span>.\u00a0<\/span>This year, we<\/span>\u00a0<\/span>had to keep all our unused business cards to ourselves<\/span>.\u00a0<\/span>And I still have some of\u00a0<\/span>last year\u2019s<\/span>\u00a0<\/span>drinks\u00a0<\/span>vouchers I had hoped to\u00a0<\/span>trade in<\/span>\u00a0at the infamous Vienna moot bar<\/span>,<\/span>\u00a0<\/span>\u201c<\/span>Aux Gazelles<\/span>\u201d<\/span>, where everyone meets for a drink or good night cap\u00a0<\/span>after the pleadings are done<\/span>.<\/span>\u00a0<\/span>\u00a0<\/span><\/p>\n

A particularly<\/span>\u00a0bitter taste remain<\/span>ed for me as a coach<\/span>\u00a0know<\/span>ing<\/span>\u00a0that\u00a0<\/span>m<\/span>y<\/span>\u00a0<\/span>team members<\/span>, after their pleadings, cannot just\u00a0<\/span>get to know<\/span>\u00a0the opposing team<\/span>\u00a0over a glass of wine at\u00a0<\/span>Aux Gazelles<\/span>, but instead close their laptops and sit in silence in their own bedrooms<\/span>\u00a0or at their kitchen<\/span>\u00a0<\/span>table<\/span>.<\/span>\u00a0<\/span>\u00a0<\/span><\/p>\n

Optimism in times of crisis<\/span>\u00a0<\/span><\/h3>\n

But this leads me to my key question:\u00a0<\/span>While all th<\/span>e<\/span>\u00a0bad news unfolded<\/span>,<\/span>\u00a0<\/span>h<\/span>ow did the\u00a0<\/span>teams<\/span>\u00a0keep up their<\/span>\u00a0good<\/span>\u00a0spirit<\/span>s<\/span>? This\u00a0<\/span>is a concern\u00a0<\/span>many of us\u00a0<\/span>currently share<\/span>\u00a0\u2013 how do we go on with our businesses in times of uncertainty,\u00a0<\/span>times which<\/span>\u00a0<\/span>may<\/span>\u00a0pose challenges to our individual mental health, optimism and motivation?\u00a0<\/span>What is the glue that holds it all together?\u00a0<\/span>I heard from\u00a0<\/span>some<\/span>\u00a0coaches that their teams\u00a0<\/span>struggled<\/span>, that they<\/span>\u00a0<\/span>either lost their<\/span>\u00a0<\/span>passion<\/span>\u00a0or dropped out of the competition altogether.\u00a0<\/span>\u00a0<\/span><\/p>\n

In all honesty, I find it hard to blame them for such a reaction to the never-ending influx of disappointing news. But m<\/span>y<\/span>\u00a0team<\/span>, on the other hand,<\/span>\u00a0recalibrate<\/span>d<\/span>\u00a0and put all their energy into organising as many online pleading sessions as possible<\/span>. They pleaded against as many as<\/span>\u00a0nine different teams over the course of three days<\/span>, something that would have been almost impossible to organise offline.<\/span>\u00a0<\/span>\u00a0<\/span><\/p>\n

When pitching and drafting this article, I was asked\u00a0<\/span>why<\/span><\/i>\u00a0<\/span>I believed\u00a0<\/span>my team\u00a0<\/span>had\u00a0<\/span>managed to\u00a0<\/span>stay positive and committed<\/span>. What exactly set them apart from the other teams who dropped out? I think that\u00a0<\/span>it was\u00a0<\/span>because they took responsibility over their work, their task, their team. They assumed ownership.\u00a0<\/span>\u00a0<\/span><\/p>\n

From the start, we\u00a0<\/span>had\u00a0<\/span>endeavoured<\/span>\u00a0to\u00a0<\/span>create<\/span>\u00a0<\/span>a<\/span>\u00a0work atmosphere<\/span>\u00a0<\/span>devoid of strict hierarchies in which we set and enforce rules\u00a0<\/span>such as<\/span>\u00a0<\/span>mandatory all-nighters<\/span>\u00a0in the weeks leading up to the submission<\/span>s<\/span>\u00a0(a tradition\u00a0<\/span>no<\/span>t<\/span>\u00a0un<\/span>common<\/span>\u00a0<\/span>among teams).\u00a0<\/span>Rather, we let the\u00a0<\/span>team members<\/span>\u00a0decide for themselves\u00a0<\/span>how to best structure their work,\u00a0<\/span>where to go\u00a0<\/span>for<\/span>\u00a0pre-moots.\u00a0<\/span>We gave recommendations, but eventually let them decide for themselves. This way, I believe, the team was\u00a0<\/span>in a position\u00a0<\/span>in which<\/span>\u00a0they were responsible for their actions, they saw the fruits of their labour along the way, and they wanted to see it through until the very end.\u00a0<\/span>\u00a0<\/span><\/p>\n

And their perseverance and determination\u00a0<\/span>were<\/span>\u00a0crowned by success as they advanced\u00a0<\/span>to<\/span>\u00a0<\/span>the Top 16 in Hong Kong, the Top 64 in Vienna, and received Honourable Mentions for two individual oralists and a memorandum.\u00a0<\/span>\u00a0<\/span><\/p>\n

\u00a0<\/span>Observations from\u00a0<\/span>a very different<\/span>\u00a0<\/span>Vis season<\/span>\u00a0<\/span><\/h3>\n

This<\/span>\u00a0time of<\/span>\u00a0prescribed self-isolation brought\u00a0<\/span>with it\u00a0<\/span>an opportunity to\u00a0<\/span>t<\/span>ak<\/span>e<\/span>\u00a0a<\/span>\u00a0few<\/span>\u00a0step<\/span>s<\/span>\u00a0back<\/span>\u00a0and reflect on<\/span>\u00a0the background against which the Vis\u00a0<\/span>was originally<\/span>\u00a0set. It is an event which holds at its core values of globalism and connectedness.\u00a0<\/span>The<\/span>\u00a0CISG as the legal substance of the competition<\/span>\u00a0is\u00a0<\/span>an instrument born in the 1980s out of a necessity for a uniform sales law in a time during which the world began to move\u00a0<\/span>even\u00a0<\/span>closer together at an exponential speed. International arbitration\u00a0<\/span>as the procedural framework of the Vis\u00a0<\/span>shares a similar history and purpose.\u00a0<\/span>\u00a0<\/span><\/p>\n

27 years down the line, in 2020, h<\/span>ow do<\/span>\u00a0we view these concepts and realities<\/span>?<\/span>\u00a0<\/span>G<\/span>lobalisation, international trade, free travel, the wealth of the industry we work in<\/span>.<\/span>\u00a0<\/span>Are we still conscious of<\/span>\u00a0the reasons why the Vis was founded, or do we take the existence of all these mechanisms for granted?\u00a0<\/span>\u00a0<\/span><\/p>\n

With regard to free travel, of course the sustainability question comes to mind.\u00a0<\/span>While<\/span>\u00a0we as a team<\/span>\u00a0plann<\/span>ed<\/span>\u00a0<\/span>the<\/span>\u00a0travels to pre-moots around Europe, we had already\u00a0<\/span>attempted to swap ou<\/span>r<\/span>\u00a0flights for trains, and started to\u00a0<\/span>questio<\/span>n<\/span>\u00a0the necessity and sustainability of an event like the Vis. Hundreds of teams, arbitrators and alumni\u00a0<\/span>annually\u00a0<\/span>travel across the world to discuss again and again an entirely fabricated case \u2013 this\u00a0<\/span>year<\/span>\u00a0about water turbines and\u00a0<\/span>witness experts<\/span>. Put in our new Covid<\/span>-19\u00a0<\/span>terminology, the Vis now\u00a0<\/span>is<\/span>\u00a0a perfect example of an \u201cavoidable\u201d and thus forbidden mass gathering.\u00a0<\/span>In<\/span>\u00a0the end, th<\/span>is<\/span>\u00a0sustainability decision was made for us.\u00a0<\/span>\u00a0<\/span><\/p>\n

Combining creative alternatives<\/span>\u00a0<\/span>with real life experience<\/span>\u00a0<\/span><\/h3>\n

In terms of the Vis, I\u00a0<\/span>believe I speak for most of us when I<\/span>\u00a0say that I am<\/span>\u00a0<\/span>impressed with\u00a0<\/span>how<\/span>\u00a0the organisers successfully\u00a0<\/span>managed<\/span>\u00a0moving the competition online<\/span>,<\/span>\u00a0and we\u00a0<\/span>all\u00a0<\/span>witnessed some excellent\u00a0<\/span>virtual pleadings<\/span>\u00a0from teams around the world. But<\/span>\u00a0all things considered,\u00a0<\/span>the Virtual Vis<\/span>\u00a0format\u00a0<\/span>cannot<\/span>\u00a0replace the experience\u00a0<\/span>of<\/span>\u00a0the real competition<\/span>\u00a0as it<\/span>\u00a0<\/span>cannot<\/span>\u00a0<\/span>truly\u00a0<\/span>reflect the\u00a0<\/span>educational and social\u00a0<\/span>spirit of the event.<\/span>\u00a0<\/span><\/p>\n

From the\u00a0<\/span>small<\/span>\u00a0insight we gained into ODR, it does seem as though holding\u00a0<\/span>hearings<\/span>\u00a0online is generally possible<\/span>. The fact that the entire competition with its thousands of sessions was moved online within just a few weeks serves as proof that the tools do exist. Some of the practitioners who saw their first online pleadings while sitting as arbitrators may now be more aware of this and perhaps the event can be a little nudge for the legal profession. And what is more, i<\/span>n times of growing\u00a0<\/span>environmental awareness<\/span>, we may ask ourselves twice in the future whether it is necessary\u00a0<\/span>and ecologically sustainable\u00a0<\/span>to\u00a0<\/span>travel<\/span>\u00a0<\/span>to a\u00a0<\/span>meeting or to fly to a pre-moot on the other side of the world<\/span>.\u00a0<\/span>\u00a0<\/span><\/p>\n

On the other hand, a certain element of the real life experience cannot be simulated. Aux Gazelles cannot exist online.<\/span>\u00a0And therefore this year, nobody got to receive the Joseph Schwartz Award for\u00a0<\/span>Academic Excellence and Party Condition<\/span>.<\/span>\u00a0<\/span>The current restrictions<\/span>\u00a0remind\u00a0<\/span>us\u00a0<\/span>of the important roles that the<\/span>\u00a0social and human element<\/span>s play behind the things we do, and why these things were established in the first place<\/span>, namely as a space for us to connect \u2013 through more than just video calls.<\/span>\u00a0<\/span>We can adapt and improvise in many regards, but some hurdles cannot be overcome.<\/span>\u00a0<\/span><\/p>\n

The<\/span>\u00a0lesson I have learned from my team is that we can make it through these times by taking responsibility and ownership of our work. We can use this opportunity to reflect on the things we used to take for granted<\/span>. And\u00a0<\/span>while<\/span>\u00a0carrying on business as usual may not be possible in some regards, we can<\/span>\u00a0instead<\/span>\u00a0rise to the challenge of exploring creative alternatives for the interim period.<\/span>\u00a0<\/span><\/p>\n
