Wagner-Arbitration

#Institutional #Mediation with Hannah Tümpel

Hannah was our special guest at the 27th arbitrattoria lunch bowl to discuss the role and impact of institutions in mediation. Three important takeaways emerged:

🕹️The most important advantage of mediation is that the parties keep full control over the outcome. Reputable institutions such as the ICC or CEDR provide effective services to facilitate the process and meet the parties’ potential needs during the mediation.

🤝 The involvement of institutions in the mediation process can be helpful to create trust among parties. If a mediation institution can build confidence that it takes into account and meets the needs of the parties in the most efficient way, parties who have not previously chosen mediation may be encouraged to do so.

🫵 One of the most important contributions of an institution in the mediation process may be the appointment of the mediator. Factors such as the mediator’s ability to communicate effectively, the parties’ preferences regarding certain characteristics, and the mediator’s, training skills and experience in this ADR process play a significant role.

🙏 We are most grateful to Hannah for having shared insights from her rich experience.

🎙️Stay tuned for our next ’24 mediation lunch bowl on 31 May with Andreas Hacke.
